TERMS AND CONDITIONS ZERO! PARAHOCKEY FOUNDATION

These are the Terms and Conditions of the ZERO! ParaHockey Foundation registered under Chamber of Commerce number 87039346, located at Weteringstraat 67, 3741 TE in Baarn and can be reached via info@zphs.nl

 

1. Definitions

In these general terms and conditions, hereinafter referred to as: ''General Terms and Conditions'', the following definitions apply:

  • ''the participant'':

    • the natural person who, pursuant to the agreement between the ZERO! ParaHockey Foundation and parents/guardians in the capacity of the Participant use the services of the ZERO! ParaHockey Foundation.

  • ''Registration form'':

    • form that is part of the website ''www.zeroParaHockey Stichting.nl'' of the ZERO! ParaHockey Foundation

  • ''Parents guardians'':

    • the natural person or legal person who enters into the Agreement for the benefit of a Participant with the ZERO! ParaHockey Foundation.

  • ''Agreement'':

    • an agreement between the ZERO! ParaHockey Foundation and Parents/guardians in respect of one or more ZERO! ParaHockey Foundation services to be provided for Parents/guardians and/or the Participant.

  • ''Participation fee'':

    • the total sum of the ZERO! ParaHockey Foundation - with regard to an Agreement concluded with Parents/guardians - services to be provided including VAT.

  • ''ZERO! ParaHockey Foundation'':

    • part of the ZERO! ParaHockey Foundation established in Baarn.

 

2. Applicability

These Terms and Conditions apply to all ZERO! ParaHockey Foundation offers made, order confirmations and agreements arising from or related thereto or other agreements.

In the event of a conflict between the provisions of the General Terms and Conditions and/or provisions of the Agreement, the latter shall prevail.

 

3. Formation of the Agreement

The Agreement is concluded through written registration or digitally by means of the Registration Form on ''www.zeroParaHockey Stichting.nl'' by the Parents/guardians and/or the Participant in the ZERO! ParaHockey Foundation.

The ZERO! The ParaHockey Foundation reserves the right to place participants on a waiting list if the maximum number of participants is exceeded. Participants will be placed in order of entry of the site's Registration Form or after registration by telephone.

When registering via the internet, there is a 48-hour reflection period. Within this period, the registration may be canceled free of charge without giving any reason, provided this is done in writing/by e-mail. From 14 days before the start of the clinic, this 48-hour reflection period expires and the cancellation conditions (as stated under the Cancellation section of these General Terms and Conditions) apply.

4. Payment

Payment must be made within 14 days of receipt of the reservation confirmation from the ZERO! ParaHockey Foundation.

When booking from 3 weeks before the start of the clinic, payment must be made within 7 days after receipt of the reservation confirmation.

In the event of late payment, the Parents/guardians are in default and the ZERO! ParaHockey Stichting reserves the right to cancel the Agreement and the Parents/guardians are liable for the cancellation costs as stated under the Cancellation section of these General Terms and Conditions.

 

5. Cancellation

Without prejudice to the provisions of Article 3, the following costs will be charged per Participant in the event of cancellation of the Agreement:

  • In case of cancellation of the Agreement up to 8 weeks before the start of the clinic, the Parents/carers owe 10% of the entire Participation Fee to the ZERO! ParaHockey Foundation.

  • In case of cancellation of the Agreement up to 3 weeks before the start of the clinic, the Parents/carers owe 25% of the entire Participation Fee to the ZERO! ParaHockey Foundation.

  • In case of cancellation of the Agreement after 3 weeks before the start of the clinic, the Parents/Guardians owe the entire Participation Fee to the ZERO! ParaHockey Foundation.

  • In the event of cancellation, the Participant is entitled to have another person put in his place. An administration fee of € 25.00 will then be charged.

  • The parents/carers can buy off the cancellation risk for a fee of 8% of the entire Participation Fee and € 2.00 administration costs per Participant, see chapter on cancellation costs.

 

6. Instructions and Rules of Conduct

The Participant must comply with all reasonable instructions of the ZERO! ParaHockey Foundation in the implementation of the Agreement. The Participant must also respect the rules of conduct which the ZERO! ParaHockey Foundation wishes to see complied with during the stay at accommodations under the Agreement.

The Participant who causes or may cause nuisance or nuisance, in such a way that the proper execution of the Agreement by the ZERO! ParaHockey Foundation is greatly hampered, the ZERO! ParaHockey Foundation from (continuation of) the clinic are excluded. All ensuing costs and damage will be borne by the Participant and the Participant is also not entitled to a refund of the Participation Fee.

 

7. Liability of the ZERO! ParaHockey Foundation 

Except in the event of damage caused by intent or gross negligence on the part of the ZERO! ParaHockey Foundation, is the ZERO! The ParaHockey Foundation is not liable for any damage suffered by the Parents/guardians and/or the Participant, including but not exhaustive: items whether or not given to the staff of the ZERO! ParaHockey Foundation as a result of theft, loss or damage to (valuable) items belonging to the Participants.

 

8. Liability Parents/Guardians

Parents/caregivers are jointly and severally liable for all damages incurred by the ZERO! The ParaHockey Foundation and/or any third party has/will arise as a direct or indirect result of an attributable shortcoming - including violation of the rules of conduct - committed by it and/or the Participant.

The Parents/Guardians indemnify the ZERO! ParaHockey Foundation against claims from third parties for compensation of damage arising from or related to the use of the Participant's facilities and/or services under the Agreement.

Participants are required to wear full goalkeeper equipment during training:

  • helmet

  • body protector

  • elbow pads

  • goalkeeper pants

  • tock (both for boys and girls)

  • legguards, kickers and hand protectors

  • stick.

  • a filled water bottle!

Participation in the clinics is at your own risk. The ZERO! The ParaHockey Foundation cannot be held liable for injuries sustained during a clinic.

 

9. Force Majeure/Change/Cancellation of the ZERO! ParaHockey Foundation 

If the ZERO! ParaHockey Foundation is wholly or partly prevented from fulfilling one or more obligations arising from the Agreement due to force majeure, including as a result of government measures due to a pandemic such as Covid19, the ZERO! The ParaHockey Foundation is entitled to offer an equivalent alternative in its opinion or to have the Agreement dissolved in whole or in part without judicial intervention, without being obliged to pay any compensation to Parents/guardians.

Force majeure also includes insufficient registrations for participation in the clinic. This is the case if the number of registrations is less than 16 participants per clinic, see also article 15 below. In this case, the registration fee already paid will be returned.

 

10.Lost property

Lost and found items will be collected by the ZERO! for another three weeks after the end of the clinic. ParaHockey Foundation preserved. After this period has elapsed, the ZERO! The ParaHockey Foundation is entitled to transfer these objects to an organization chosen by them.

 

11. Participant Insurance

Parents/carers and/or Participant are obliged to take out travel accident insurance for the Participant, preferably with extensive sports coverage, during the period of the clinic.

 

12. Governing Law and Disputes

The Agreement and all agreements arising from it are governed exclusively by Dutch law.

All disputes that may arise between the parties as a result of the Agreement or agreements arising from it, will be settled by the competent court of the court in Utrecht.

 

13. Redemption cancellation risk

It is possible to buy off the cancellation risk for a fee of 8% of the entire Participation Fee (plus € 2.00 administration costs), this can be concluded up to a maximum of 10 days after registration, but no later than 7 days before the clinic.

When canceling a clinic, no reason is required if parents/carers have taken out cancellation insurance. In case of cancellation with cancellation insurance, parents/guardians will receive a refund of the clinic amount, minus the costs of the cancellation insurance.

 

14. Use of image & sound

By participating in the ZERO! ParaHockey Foundation 'Parents/carer and/or the Participant agree to (audio)visual recordings during the event, unless stated otherwise in the Agreement. The (audio) visual recordings can be used to decorate and/or promote the ZERO! ParaHockey Foundation. Participation in the ZERO! The ParaHockey Foundation means that the Participant hereby fully and definitively waives any claims to any right, title or interest vis-à-vis the organization and owners of the ZERO! ParaHockey Foundation. This proof of release is binding on trustees, assigns and legal successors of the Participant and will inure to the benefit of the aforementioned party.

 

15. Minimum Numbers

With all ZERO! ParaHockey Foundation requires a minimum number of participants. If the certain minimum number of participants does not register at a clinic, the ZERO! The ParaHockey Foundation strives to decide this no later than 14 days, but in any case 5 days in advance, whether a clinic will be (partially) canceled or changed to an alternative that is as similar as possible. However, in certain cases, despite the fact that the minimum number of participants has not been reached, the sports clinic can still take place. The minimum number may then deviate in certain cases. Age groups can also be merged in certain weeks.
